Our experienced team, led by Robert Cain, handles a broad range of client transactions in the UK and around the world.
We assist businesses in conducting their commercial activity by identifying the risks and opportunities. Through careful planning, effective negotiation and clear drafting we help our clients get results.
Our particular strengths in the specialised fields of intellectual property and information technology mean that we are ideally placed to advise clients whose business is the use or exploitation of technology.
Information technology law encompasses legal issues relating to the computer and communications technology industries. We act for a wide range of clients in the computer and communications industries including: software houses; software distributors; computer games suppliers; internet based service and product companies; software services companies; managed service providers; website designers, web service providers and telecoms companies. We draft and negotiate agreements for both suppliers and purchasers including: the supply of computer and telecoms systems; software development; licensing of IP; software distribution; website design; e-commerce; IT outsourcing; technology joint ventures; and the purchase of or raising money for IT or internet businesses.
On the intellectual property side we help clients identify exploit and protect their IP. We help and advise on searching of registered trade marks and designs as well as patents. We can manage the process of IP registration. If clients wish to obtain or grant a license of IP we can draft and negotiate its terms. We help to ensure that investment in the creation of intellectual property rights is properly exploited by its owners and protected by licensing and confidentiality agreements.
In the field of commerce we deal with terms of sale/purchase, agency, distribution, franchising, partnership, joint ventures, research and development and competition law.
If it all goes wrong and a computer or telecoms system does not function as the customer expects, we will help to resolve disputes between customer and supplier. If the ownership or use of intellectual property is contested we can advise our clients on their rights and how to protect them. This may take the form of swift and effective action against infringers or defending our clients against claims of infringement.
The Technology & Commerce Team provides client specific advice and general information through seminars, workshops, news bulletins (watch this space and comets) and on its web pages and of course through good old fashioned personal contact.
