The draft National Minimum Wage (Amendment) (No 2) Regulations 2023 (expected to come into force on 1 April 2024) have been laid before Parliament.
They will remove the exemption from the national minimum wage (NMW) for live-in domestic workers. What does this mean? In brief, workers who live in their employer’s family home (but are not actual family members in respect of domestic duties) and are not charged for food or accommodation do not currently qualify for the NMW. The draft regulations provide that live-in domestic workers previously covered by this exemption must be paid NMW.
